Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ProducerTrackr mobile application and related services (collectively, the "Service") provided by ProducerTrackr ("we", "us", or "our").

Please read these Terms carefully. By creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf.

If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Account Creation and Security

To access certain features of the Service you must create an account using Sign in with Apple or another supported authentication method. You agree to:

Provide accurate and complete information when creating your account
Keep your authentication credentials secure
Notify us immediately of any unauthorized access at support@producertrackr.com
Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be compromised.

3. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the Service on Apple-branded devices that you own or control, solely for your personal, non-commercial use.

This license is granted by ProducerTrackr to you and is not transferable. You may not:

Sell, rent, lease, sublicense, or otherwise commercially exploit the Service
Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law permits despite this limitation
Remove or alter any proprietary notices on the Service
Use the Service to build a competing product or service
Use any automated means (scrapers, bots) to access the Service or its content

4. Subscriptions

4.1 Subscription Plans

The Service offers auto-renewable subscriptions on a yearly or monthly basis. Current pricing and trial periods are displayed in the app at the point of purchase.

4.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel auto-renewal at least 24 hours before the end of the current period. Your Apple ID will be charged for the renewal within 24 hours prior to the end of the current period at the displayed renewal price.

4.3 Free Trials

If your subscription includes a free trial, the trial begins on the date of purchase. Unless you cancel before the trial ends, your subscription will automatically begin and your Apple ID will be charged. You may cancel during the trial in your Apple ID Settings without being charged.

4.4 Cancellation

You can cancel your subscription at any time in your Apple ID Settings:

Settings → [Your Name] → Subscriptions → ProducerTrackr → Cancel Subscription.

Cancellation takes effect at the end of the current billing period. You retain access to subscriber features until then.

4.5 Refunds

All purchases are processed by Apple and are subject to Apple's refund policy. We do not directly issue refunds for in-app purchases. To request a refund, visit https://reportaproblem.apple.com.

4.6 Price Changes

We may change subscription prices from time to time. Any price change will not affect your current billing period and will be communicated in advance in accordance with applicable Apple guidelines and law.

5. User-Generated Content

5.1 Your Content

The Service allows you to upload a profile photo and create a list of followed producers ("Your Content"). You retain ownership of Your Content. By submitting Your Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process Your Content solely as necessary to provide the Service to you.

5.2 Your Responsibilities

You represent and warrant that:

You own or have the necessary rights to Your Content
Your Content does not infringe any third party's rights (copyright, trademark, privacy, publicity, etc.)
Your Content does not violate any applicable law

5.3 Removal

We reserve the right to remove Your Content at any time, with or without notice, if we believe it violates these Terms or applicable law.

6. Prohibited Uses

You agree not to:

Use the Service for any unlawful purpose
Upload content that is hateful, threatening, harassing, defamatory, obscene, or otherwise objectionable
Impersonate another person or entity
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any account or system
Use the Service to send unsolicited communications (spam)
Circumvent any technical limitation, access control, or security measure
Violate Apple's Media Services Terms and Conditions or App Store Terms

7. Intellectual Property

7.1 Our Property

The Service, including all software, text, graphics, audio, video, logos, and trademarks, is owned by ProducerTrackr or its licensors and is protected by intellectual property laws. Producer names, song titles, album art, and biographical data displayed in the Service are the property of their respective owners and are used under fair use, license, or with permission where applicable.

7.2 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation to you.

8. Third-Party Content and Services

The Service includes links to third-party services such as Apple Music and Spotify. We do not control these services, do not endorse their content, and are not responsible for their availability, accuracy, or practices. Your use of any third-party service is subject to that service's own terms and privacy policy.

Producer images, track artwork, and biographical content may be sourced from public catalogs (MusicBrainz, Discogs, etc.) and licensed providers. We make reasonable efforts to ensure accuracy but make no warranty regarding the completeness or correctness of catalog information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PRODUCERTRACKR, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) USD $50.

Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless ProducerTrackr, its affiliates, and their respective officers, employees, and agents from any claim, liability, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, Your Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time by deleting your account (contact support@producertrackr.com) and uninstalling the app.

Sections that by their nature should survive termination (including Sections 5.1, 7, 9, 10, 11, 13, and 14) will survive.

13. Apple-Specific Terms

These Terms are between you and ProducerTrackr, not Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.

Scope of license. The license granted to you in Section 3 is limited to a non-transferable license to use the Service on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Maintenance and support. ProducerTrackr is solely responsible for providing any maintenance and support services with respect to the Service. Apple has no obligation whatsoever to provide any maintenance and support services.
Warranty. ProducerTrackr is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.
Product claims. ProducerTrackr, not Apple, is responsible for addressing any of your or any third party's claims relating to the Service or your possession and/or use of the Service.
Intellectual property rights. In the event of any third-party claim that the Service or your use of the Service infringes that third party's intellectual property rights, ProducerTrackr, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the state in which ProducerTrackr is principally located, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction in those courts.

If you are a consumer residing in the European Union, you may have additional rights under applicable consumer-protection laws and may bring claims in your local courts.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

Update the "Last updated" date at the top of these Terms
Notify you within the app or by email at least 14 days before the changes take effect

Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes.

16. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ProducerTrackr regarding the Service and supersede any prior agreements.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely.
